1. Introduction and Acceptance

Welcome to CarModSnap (https://carmodsnap.com), an AI-powered car modification visualization service operated by Frank, an independent developer ("we", "us", "our").

By creating an account, accessing, or using CarModSnap, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the service.

2. The Service

CarModSnap allows you to upload vehicle photos and reference images and use AI tools to visualize wraps, wheels, body kits, and other appearance modifications, as well as related features such as showcases, project saving, and shop discovery. Available features depend on the plan you choose; see the Pricing page for current details.

CarModSnap provides digital visualization software only. We do not sell physical car parts, wraps, wheels, body kits, or installation services through this website, and any local shop quote feature is intended to help you contact independent third-party installers.

3. Eligibility and Accounts

  • You must be at least 13 years old (or 16 in the EEA/UK) to use CarModSnap, and at least the age of legal majority in your jurisdiction to enter a paid subscription.
  • You are responsible for the accuracy of information you provide at sign-up and for keeping your account credentials confidential.
  • You are responsible for all activity that occurs under your account. Notify us at admin@carmodsnap.com as soon as possible if you suspect unauthorized access.

4. Pricing, Payments, and Refunds

  • Plan fees, billing intervals, included credits, and currency are shown on the Pricing page and at checkout.
  • Payments are processed by our payment provider (currently Creem, with Stripe and PayPal supported in some flows). By completing a purchase you also accept the payment provider's terms.
  • Subscriptions renew automatically at the end of each billing period until you cancel from Settings → Billing. You can cancel at any time; cancellation takes effect at the end of the current period.
  • Refunds are governed by our Refund Policy, which is incorporated into these Terms by reference. The Refund Policy controls in case of any conflict with this section.
  • Prices may change. We will give reasonable advance notice of any change before it applies to your next renewal.

5. Credits and Usage

  • Paid plans grant a number of "credits" usable within the billing period; credits and the actions that consume them are described on the Pricing page and inside the product.
  • Credits are not redeemable for cash, do not earn interest, and (except as required by mandatory law or by our Refund Policy) are not transferable between accounts.
  • We may impose reasonable rate limits, queue limits, or anti-abuse limits to protect service quality for all users.

6. Your Content

  • You retain ownership of vehicle photos, reference images, and prompts you upload ("User Content").
  • You grant us a limited, non-exclusive, worldwide license to host, process, and display your User Content only as needed to provide the service to you (e.g. to render generations, display them in your dashboard, and back them up).
  • We do not use your User Content to train, fine-tune, or evaluate AI models. See our Privacy Policy for details.
  • You are responsible for having the rights to upload any vehicle photos or reference materials you submit.

7. AI-Generated Outputs

  • Subject to your plan and to your compliance with these Terms, you receive a worldwide right to use AI-generated outputs you create on CarModSnap for personal use; commercial use requires a plan that explicitly includes a commercial license (see Pricing page).
  • AI-generated outputs may not be exact, accurate, or to-scale renderings of real-world vehicles, paint, materials, or fitment. Use them for planning and concept validation, not as a substitute for installer-verified samples, manufacturer specs, or in-person inspection.
  • The underlying AI models, software, and infrastructure used to produce outputs remain the property of the respective AI providers and of CarModSnap.

8. Trademark and Brand Disclaimer

Vehicle model names, manufacturer marks, and any third-party logos or designs that appear in templates, prompts, demos, or generated outputs are used for identification, compatibility, and reference only. CarModSnap is an independent service and is not affiliated with, endorsed by, or sponsored by any vehicle manufacturer or trademark owner unless explicitly stated.

9. Acceptable Use

You agree not to:

  • Use CarModSnap to generate, distribute, or store unlawful, defamatory, harassing, hateful, sexually explicit, or violent content;
  • Use the service to depict real, identifiable individuals without their consent in a misleading or harmful way;
  • Misrepresent vehicle ownership, license plates, or VINs in ways intended to deceive;
  • Attempt to access, scrape, or interfere with parts of the service you are not authorized to access;
  • Reverse-engineer, copy, or resell the CarModSnap service, our APIs, or substantial portions of the user interface, except as expressly permitted by your plan;
  • Use bots or automated tools to abuse credit systems, free trials, or rate limits;
  • Use the service to violate any applicable law or third-party right.

We may suspend or terminate accounts that violate this section.

10. Suspension and Termination

  • You may close your account at any time from Settings → Billing or by emailing admin@carmodsnap.com.
  • We may suspend or terminate access if you breach these Terms, if continued provision would expose us or other users to legal or security risk, or to comply with law.
  • On termination, your right to use the service ends. Sections that by their nature should survive (e.g. content licenses, disclaimers, limitation of liability, governing law, payment-related obligations) survive termination.

11. Service Availability and Changes

  • We aim for high availability but do not promise that the service will be uninterrupted, error-free, or always available.
  • We may modify, add, or remove features at any time. If we make a material change that meaningfully reduces a feature you have already paid for in a current billing period, you may request a refund under the Refund Policy.

12. Disclaimer of Warranties

The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and the accuracy or completeness of AI-generated outputs.

13. Limitation of Liability

To the fullest extent permitted by law, neither CarModSnap, its operator, nor its providers will be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of the service.

Our total aggregate liability arising out of or related to the service is limited to the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) USD 50.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable mandatory law (such as liability for fraud, gross negligence, or death/personal injury caused by negligence, where applicable).

14. Indemnification

You agree to indemnify and hold harmless CarModSnap, its operator, and its providers from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of (a) your User Content, (b) your use of the service in breach of these Terms, or (c) your violation of any law or third-party right.

15. Governing Law and Dispute Resolution

These Terms, and any dispute arising out of or related to them or to the service, are governed by applicable law, with the following principles:

  • If you reside in the EU/EEA, UK, or any country whose mandatory consumer-protection law would otherwise apply, those mandatory consumer rights are not affected by these Terms, and you may bring claims in the courts of your country of residence.
  • For all other matters, the parties agree to first attempt to resolve disputes in good faith via email at admin@carmodsnap.com, and, if not resolved within 60 days, through binding individual arbitration or the competent courts at the operator's primary place of operation, to the extent permitted by applicable law.
  • Class actions and class arbitration are excluded to the maximum extent permitted by law.

16. Changes to These Terms

We may update these Terms from time to time. The current version is always available on this page; the date in the "updated_at" field reflects the most recent material change. If a change is material, we will give you reasonable notice (e.g. by email or in-product notice) before it takes effect. Your continued use of the service after the change takes effect means you accept the updated Terms.
